Benitez's Answer to the California Medical Association's Amicus Curiae Brief

Filed in the California Court of Appeal

Case: Benitez v. North Coast Women's Care Medical Group

Friday, June 3, 2005
| Court of Appeal of the State of California, Fourth Appellate District, Division One

Though the California Medical Association rightly condemns sexual orientation discrimination, its claim that a physician should be able to choose which procedures he performs is irrelevant to this case. Guadalupe Benitez was denied care based on her sexual orientation, not the physician's religious objections to the treatment and it should therefore be considered discrimination under the law.
