The U.S. Department of Health and Human Services (HHS) has sought to undermine health care access for LGBTQ people. Since the Trump Administration took office, HHS has:

  1. issued a revised rule rolling back regulatory nondiscrimination protections under the Affordable Care Act as they apply to LGBTQ people, particularly transgender people;
  2. issued a Denial-of-Care Rule that invites health care workers and facilities to impose their religious beliefs on patients, arbitrarily deciding who receives care and who doesn’t;
  3. created a new unit within the HHS Office of Civil Rights (OCR) called the “Conscience and Religious Freedom Division;” and 
  4. announced its nonenforcement of regulatory prohibitions on discrimination against LGBTQ people by HHS grantees.

Each of these actions will almost certainly result in the unconstitutional denial of medical care and cause potentially life-threatening harm to patients, in particular to LGBTQ people and women.
