Life Without Fair Courts Illustration Contest

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.

Welcome to the Life Without Fair Courts Illustration Contest. This Official Contest Rules and attached Submission Agreement (collectively, the “Rules”) set forth the rules and regulations of the Life Without Fair Courts Illustration Contest (the “Contest”) presented by Lambda Legal, Prism Comics, and media sponsor, The Advocate (collectively, the “Sponsors”). Lambda Legal is the administrator of the Contest (the “Administrator”), the principal place of business of which is 120 Wall Street, Suite 1500, New York, NY 10005. Any person who contributes to the creation of the submitted entry (an “Entrant”) must sign a Submission Agreement and submit it to the Administrator. Please read the Rules carefully before submitting an entry or participating in the Contest as the Rules contain important information about eligibility to enter the Contest, the rules of the Contest, the rights to any submitted entries and other important information. By submitting an entry form, you accept the Rules and agree to be bound by all of its terms. If you do not agree with the Rules, do not submit an entry.

A. Eligibility and Participation

YOU MUST BE AT LEAST 18 YEARS OF AGE OR OLDER TO SUBMIT AN ENTRY AND PARTICIPATE IN THE CONTEST. THIS CONTEST IS VOID WHERE PROHIBITED.

Entrants are responsible for compliance with applicable laws in jurisdictions where they reside.

Employees and agents of any of the Sponsors and their respective affiliated companies and members of the immediate families of each are not eligible to participate in the Contest or receive prizes. The Contest is subject to all local, state and federal laws and regulations. By entering the Contest, all entrants agree to be bound by these Rules and to comply with all federal, state and local laws and regulations.

B. Submission of Entries; Deadlines

To be eligible to participate, you must successfully submit your entry either by email (faircourtscontest@lambdalegal.org) or by mail (address above, c/o Fair Courts Contest) by April 16, 2007. The Sponsors shall have no liability or responsibility for any technical malfunction or failure of any Internet or network connection or failure of mail delivery service, regardless of cause, which prevents or materially adversely effects the participants ability to submit an entry in a timely manner or at all.

The Contest begins on January 16, 2007 and all entries must be submitted (or postmarked) no later than 11:59 p.m. Eastern Standard Time on April 16, 2007. In completing the Submission Agreement and submitting your design, you must provide your name, valid email address and other required information. You may also be required to provide proof of age at any time by the Administrator and will be required to provide proof of age if you are selected to win a prize.

Any two-dimensional, color or black and white visual creation that can be printed and contained within a 6-by-9-inch page may be submitted.

Each submission must be the property of and an original work of the entrant. Each entrant may submit no more than 10 entries in total. Attempts to submit a greater number of entries will be grounds for disqualification by the Administrator.

By submitting any entry, you agree to be bound by the Rules, including, without limitation, the Submissions Agreement provisions, which all entrants must sign and send in to the Administrator. The Administrator shall have sole discretion over which entries will be considered by the panel of judges based upon the rules and criteria as set forth herein.

C. Winner Selection and Notification

  1. Judging. All eligible entries will be reviewed by the Administrator. A panel of judges selected by the Administrator will choose the finalists. The judges shall have the sole discretion to select the finalists and their decision shall be final and binding on all parties. The finalists will be selected by the judges based on such criteria as they determine to be appropriate, including but not limited to: (a) adherence to the submission guidelines, (b) uniqueness and originality of design, (c) creativity of design, (d) completeness of design and (e) relevance to the question of what your life would look like without fair courts.
  2. Finalists. The finalist entries will be posted online through the Administrator’s website on or around May 21, 2007. This date is subject to change depending upon the number of qualified entries and contest participants. Visitors to the website will be able to submit their votes for who they believe is the best entry. Only one vote per valid email address will be allowed. The entry that receives the highest number of online votes will be deemed the first prize winner, second highest will be the second prize winner and third prize will be the third prize winner. In the event of a tie, the Administrator has the sole discretion to decide the winner.

  3. Date of Judging. The judges will select the finalists by May 21, 2007. The online voting period will commence on May 22, 2007 and continue through June 21, 2007. These dates are subject to change depending upon the number of qualified entries and contest participants.

  4. Notification of Winners. Winners of prizes shall be notified as soon as possible following the selection of the winners by online voting. In addition to the Submission Agreement signed and submitted in order to be eligible for judging, as a condition to receipt of their prize, prize winners may also be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release and provide any additional information (such as social security number), that may be required by the Sponsors, except where prohibited by law. Except where prohibited by law, each prize winner must return all required documents within seven (7) days following the notification of winning or such winner's prize may be forfeited. It is the sole responsibility of an entrant to maintain his/her contact information as current. There will be no liability for any potential winner notification that is lost, intercepted or not received by the potential winner for any reason.

D. Prizes

NOTE: If more than one entrant is responsible for creating a winning entry, the prize will be distributed according to the name designated on the Submission Agreement as the prize recipient for the entry. There will be only one prize distributed per winning entry.

Contest Grand Prize: The contest first prize winner will receive nationwide exposure through the print version of The Advocate, showcasing their winning entry.  The contest first prize winner will also receive two round-trip airline tickets for travel within the 48 contiguous states (some restrictions apply) through American Airlines.

Contest Finalist Prizes: The second and third prize winners will receive shopping sprees, valued at $150.00 and $50.00, respectively, to be redeemed at a comic store of their choice, chosen through Comic Store Locator Services. This prize is donated by Diamond Comics Distributors.

Odds: Odds of winning a price will vary depending upon the number of actual Contest participants. In the event any entry or entrant is deemed ineligible, the Administrator may award the prizes to alternate entries as it deems suitable. Winners may be required to pay customs, duty charges and/or taxes.

E. Miscellaneous

The Contest and the Rules shall be governed by and construed in accordance with the laws of the State of New York, exclusive of its provisions on conflicts of laws. In respect of any dispute relating to the Contest and/or the Rules, such dispute shall be brought exclusively in a court of competent jurisdiction sitting in New York, New York. The Contest and entry therein is void where prohibited. Unclaimed prizes will not be awarded. No substitution of prize is offered, and prizes may not be redeemed for cash value, except as determined by the Sponsors in their sole discretion. Each prize winner will be solely responsible for all applicable federal, state and local taxes on prizes, and, if applicable, may receive an IRS Form 1099 for the retail value of such prize. All other expenses on the receipt and use of each prize not specifically mentioned herein are the sole responsibility of each applicable prize winner.
