You have a role to play. Help make sure that courts can continue to make decisions based on the federal and state constitutions and other laws – not politics or popular opinion. When courts rule in favor of lesbian, gay, bisexual and transgender equality, they sometimes face anti-court backlash, such as impeachment threats or proposed legislation to take courts out of the decision making process. What Lambda Legal’s Doing
Supporting an independent judiciary
In the wake of the marriage equality decision in New Jersey, Lambda Legal wrote a letter to President Bush calling upon him to end his attacks on judges and courts across the country. Lambda Legal recognizes that politicians must stop threatening the judiciary when they disagree with decisions. This rhetoric is counter to what the founders of this country established when they created the system of checks and balances.
Lambda Legal is also helping to defend fair courts in Florida in a case brought by an extremist that, if successful, could allow known biased judges to sit on the bench.
Asking the right questions
When President Bush nominated Leslie Southwick, Harriet Miers, John Roberts, Terrence Boyle, William Pryor and Samuel Alito, Lambda Legal responded — calling on the judicial nominating committee to ask questions regarding the candidate’s ability to render fair decisions on issues concerning LGBT and HIV-affected people. Congress listened to us by asking many of the questions we posed. Lambda Legal remains dedicated to assuring the appointment of fair-minded judges.
