Give President Obama’s Supreme Court nominee a fair hearing and a swift vote.

The Constitution is clear: The President nominates justices to the Supreme Court, and the Senate confirms or rejects them.

Some Republican leaders in Congress are calling into question President Obama’s authority to fulfill his constitutional responsibility to fill court vacancies.  Some senators are even saying they will oppose anyone President Obama nominates to the Court.

President Obama has stated that he intends to put forward a nominee. The Senate should judge that candidate fairly, rather than reject someone sight-unseen on partisan grounds.

The Constitution embodies and seeks to safeguard our nation’s highest values, including a commitment to protecting individual rights against overreaching majority will. Court victories have and will continue to be a vital path to equality for LGBT people, people of color, women and other marginalized groups. 

The work of the U.S. Supreme Court is too important to leave a seat vacant for a year.
