Decision from the Superior Court of the State of Pennsylvania

Jones v. Boring

This decision upheld a county court's ruling which granted primary custody of twin boys to their non-biological lesbian mother instead of her ex-partner to whom the boys were born from artificial insemination.  The ruling found that it was in the best interest of the children to remain with their non-biological mother who had been acting as their caretaker.  The court also found that the non-biological mother did not need to establish that the biological parent is unfit to justify her claim to custody.
