Jacoby v. Jacoby
In a 2-1 decision, the Appellate Court reversed a trial court's ruling that awarded sole custody of the Jacoby children to their father instead of their mother who identifies herself as a lesbian. The decision stated that the mother's sexual orientation showed no evidence of harming the children and that anti-gay prejudices should not be considered in custody cases.
