In re Marriage Cases
In this historic decision, the court found that same-sex couples had the fundamental right to marriage. Further, the judge stated that to deny marriage to same-sex couples was gender discrimination and violated the equal protection guarantees in the Constitution. The state will appeal this decision to the California Court of Appeals.
