Decision from the California Court of Appeals
Galanty v. The Paul Revere Life Insurance Company
The California Court of Appeals affirmed a lower court's dismissal of this case, stating that HIV could be considered an excluded "manifestation" of disability. The court ruled that insurance companies could refuse to pay AIDS-related disability claims. The Supreme Court of the State of California would later reverse this decision ruling that insurance companies were violating state law when they denied payments for AIDS-related diabilities and were responsible for their clients' benefits.
