Friend-of-the-Court brief of NAACP Legal Defense and Educational Fund, Inc.

The NAACP Legal Defense and Educational Fund, one of the nation’s preeminent civil rights legal organizations, encourages this Court not to endorse discrimination against gay men and lesbians by denying their fundamental right to marry the person they love. As the brief discusses, the fundamental right to marry extends to same-sex couples under well-established precedent of the United States Supreme Court. Prohibiting same-sex couples from marrying violates the Due Process Clause and the Equal Protection Clause.
