Lambda Legal Decries DOMA Defenders' Refusal to Allow Taping of Court Hearing 09/12/2011

Lawyers for the Bipartisan Legal Advisory Group of the U.S. House of Representatives (BLAG) informed U.S. District Court Judge Jeffrey White that they "prefer not" to participate in a pilot project to video-tape oral arguments at an October 21, 2011 hearing in Golinski v OPM, a federal challenge to the Defense of Marriage Act (DOMA).

Federal Court Continues Reprieve for Family Health Coverage for Gay and Lesbian Arizona State Employees 09/06/2011

(San Francisco, September 6, 2011)—The U.S. Ninth Circuit Court of Appeals today upheld an injunction that temporarily maintains family health coverage for gay and lesbian employees of the State of Arizona until a court issues a final decision in the case.

Federal Court Upholds Transgender People's Right to Access Medical Treatment in Prison 08/05/2011

The U.S. Court of Appeals for the Seventh Circuit today upheld the right of transgender people to receive medical care while they are incarcerated. The American Civil Liberties Union, the ACLU of Wisconsin and Lambda Legal had challenged a Wisconsin law that prohibited prison doctors from prescribing hormone treatment or sex reassignment surgery to transgender inmates.

DOJ Delivers Powerful Critique of DOMA in Lambda Legal Case 07/05/2011

On Friday, the U.S. Department of Justice (DOJ) filed a brief strongly arguing that the Defense of Marriage Act (DOMA) is unconstitutional in a case brought by Lambda Legal and Morrison & Foerster LLP on behalf of Karen Golinski, a lesbian federal court employee denied medical coverage for her wife, whom she married when same-sex couples could do so in California. The DOJ had previously announced they would no longer defend DOMA, but this is the first legal filing in the country in which they have fully argued to a court that DOMA is unconstitutional. They asked the federal court not to dismiss Golinski's claim.

LGBT Elders Raise Serious Fears about Long Term Care Facilities 04/05/2011

(Washington, April 5, 2011) - A majority of lesbian, gay, bisexual, and transgender (LGBT) older adults who answered a national online survey believe that staff of long-term care facilities would discriminate against an LGBT elder who was open about his or her sexual orientation, and more than half believe that staff or other residents would abuse or neglect an LGBT elder.

DOMA Shift Leaves Government Out of Excuses, Lambda Legal, Morrison & Foerster Inform Judge 03/03/2011

Lambda Legal and Morrison & Foerster LLP today told a federal judge that government attorneys have shown they have no further arguments and therefore no further legal barrier exists to a married lesbian federal employee receiving spousal health benefits already provided to her heterosexual co-workers. U.S. Department of Justice (DOJ) attorneys had argued that, among other reasons, the so-called Defense of Marriage Act (DOMA) prohibits the employer-provided medical insurance that Karen Golinski had requested for her spouse, Amy Cunninghis. Lambda Legal and Morrison & Foerster represent Golinski, a 19-year-employee of the U.S. Ninth Circuit Court of Appeals.

Federal Court Hears Arguments in Case Defending Transgender People's Right to Access Medical Treatment in Prison 02/07/2011

Today the Seventh Circuit Court of Appeals heard oral arguments in a case defending the right of transgender people to receive medical care while they are incarcerated. Under Wisconsin law, prison doctors are prohibited from prescribing hormone treatment to transgender inmates. The law is being challenged by Lambda Legal, the American Civil Liberties Union, and the ACLU of Wisconsin.
